Other forms of discrimination include hiring or firing based on membership in a minority group and using a person's minority group status against her in decisions about job duties and promotions.
If you think you've been discriminated against, the EEOC investigates your claim and either sue on your behalf or authorize you to sue using your own attorney. Protected Class Membership Federal law requires that people not be discriminated against on the basis of age, race, gender, religion, disability, national origin, genetic information or pregnancy.
To be eligible to make an EEOC complaint, the discrimination must fit into one of these categories. Discrimination on the basis of sexual orientation, for example, is not investigated by the EEOC, although some states do prohibit such discrimination.
The discrimination must be reasonably related to membership in a protected class, and a single instance of meanness by a boss generally is not considered discrimination, even if it's directed at a member of a protected class. Hostile Work Environment Verbal abuse typically falls under the hostile work environment prohibition in federal law.
If an employee or supervisor repeatedly abuses a member of a protected class on the basis of her membership in that class, this is discrimination. Even if the abuse does not occur at the direction of the company, your business still could be held liable if it does nothing to stop the abuse.
The verbal abuse does not necessarily have to be overt. For example, making jokes about women in sports could be a form of discrimination even if an employee never directly insults an individual employee's competence.
Other Discrimination Other forms of discrimination include sexual harassment, which occurs when businesses create a hostile and sexualized work environment or when they demand sexual favors from employees. Federal law also requires that employers make reasonable accommodations for disabled people, that pregnancy not be considered in decisions about hiring and firing and that employers take reasonable measures to prevent discrimination.
If an employer has never hired a woman manager, this might be discrimination even if the employer is not deliberately discriminating. Generally, your business must have more than 15 employees. If an employee alleges your business has discriminated against her, she'll have a set period of time -- usually days -- during which she can file a complaint.
The EEOC either takes up her complaint or declines to sue on her behalf. If the EEOC declines to sue, she can hire her own lawyer.
